CIRCULAR
PROVISION OF TITLE-BASED REFRESHER TRAINING PROGRAMS FOR HEALTHCARE OFFICERS BY TRAINING AND RESEARCH INSTITUTIONS
Pursuant to the Law on public employees No. 58/2010/QH12 dated November 15, 2010;
Pursuant to the Government’s Decree No. 101/2017/ND-CP dated September 01, 2017 on training and refresher training courses for officials and public employees;
Pursuant to the Government’s Decree No. 75/2017/ND-CP dated June 20, 2017 defining functions, tasks, powers and organizational structure of the Ministry of Health;
At the request of the Head of the Organization and Personnel Department;
The Minister of Health promulgates a Circular providing title-based refresher training programs for healthcare officers by training and research institutions.
Article 1. Scope and regulated entities
1. This Circular provides for the provision of title-based refresher training programs for healthcare officers, including:
a) Refresher training courses provided by training institutions;
b) Professional standards for lecturers, training materials, facilities and experience in organizing training courses of training institutions.
2. This Circular applies to training and/or research institutions that are universities and colleges providing training courses in healthcare disciplines; healthcare service providers that have function to provide training and refresher training programs; training centers for healthcare and population officers (hereinafter referred to as “training institutions”) and relevant authorities, organizations and individuals.
Article 2. Refresher training programs provided by training institutions
1. Universities providing bachelor's degree or higher courses in healthcare disciplines and healthcare service providers of special rank that meet relevant standards set forth in Articles 3, 4, 5 and 6 hereof are allowed to provide title-based refresher training programs for Rank-I, Rank-II, Rank-III or Rank-IV healthcare officers.
2. Rank-I healthcare service providers and training centers for healthcare and population officers that meet relevant standards set forth in Articles 3, 4, 5 and 6 hereof are allowed to provide title-based refresher training programs for Rank-II, Rank-III or Rank-IV healthcare officers.
3. Colleges providing training courses in healthcare disciplines and rank-II healthcare service providers that meet relevant standards set forth in Articles 3, 4, 5 and 6 hereof are allowed to provide title-based refresher training programs for Rank-III or Rank-IV healthcare officers.
Article 3. Professional standards for lecturers
1. Lecturers are required to meet professional standards for lecturers in charge of training or refresher training programs provided for officials and public employees set forth in Article 34 of the Government's Decree No. 101/2017/ND-CP dated September 01, 2017.
2. A visiting lecturer is required to:
a) have professional qualifications and experience suitable for the relevant refresher training program;
b) meet standards for a visiting lecturer as prescribed in Article 35 of the Decree No. 101/2017/ND-CP.
3. Lecturers of a training institution must be capable of taking charge of at least 50% of total refresher training programs which it provides.
Article 4. Training syllabus standards
1. A training institution must have one of the following training syllabi:
a) Training syllabus compiled by the training institution itself and given approval as regulated;
b) Training syllabus compiled by another training institution, appraised and approved as regulated;
c) Training syllabus approved by the Ministry of Health.
2. Refresher training syllabi must be regularly updated in order to meet standards for relevant titles of trainees.
Article 5. Facility standards
1. Classroom and equipment standards: Provide adequate seats and equipment suitable for both learning and teaching.
2. Educational materials: Provide adequate and quality educational materials for learners.
3. IT application: Develop a website providing updated lists of lecturers, training programs and educational materials used in each program, and develop a database system storing information concerning provided training programs and learners.
Article 6. Training experience
A training institution is required to have at least 03 years’ experience in providing training or refresher training courses.
Article 7. Effect
This Circular comes into force from December 10, 2018.
Article 8. Terms of reference
If legislative documents and regulations referred to in this Circular are amended, supplemented or superseded, the new ones shall apply.
Article 9. Implementation
1. The Organization and Personnel Department affiliated to the Ministry of Health shall play the leading role and coordinate with relevant departments, divisions, authorities and units in:
a) Organizing the implementation of this Circular;
b) Conducting the inspection of maintenance of relevant standards enshrined in this Circular by training institutions.
2. Authorities and organizations that have the function to provide advice about the training and refresher training for healthcare officers of ministries, ministerial-level agencies, the Government's affiliates, central-level socio-political organizations and Provincial-level People's Committees shall, pursuant to regulations herein, request competent authorities to assign training institutions under their management to provide title-based refresher training programs for healthcare officers and send the list of such training institutions to the Ministry of Health for consolidation and management.
3. Training institutions assigned to provide title-based refresher training programs for healthcare officers shall implement this Circular, and submit reports on the implementation of this Circular to the Ministry of Health, the Ministry of Home Affairs and authorities assigning training tasks to them by November 30 every year.
4. Chief of the Ministry's Office, the Ministry’s Chief Inspector, General Directors/ Directors of Departments/ General Departments affiliated to the Ministry of Health, and relevant authorities, organizations and individuals shall implement this Circular.
Difficulties that arise during the implementation of this Circular should be promptly reported to the Ministry of Health for consideration./.
